GENERAL RENTAL CONDITIONS


The general rental conditions are part of the rental contract between the tenant and

A. FEES AND FORM OF PAYMENT
 
A - I 
Payment is due per the following schedule:
40% after confirmation of reservation
40% thirty days prior to arrival
20% upon delivery of the keys

A - II
Fees include the consumption of water, electricity, gas, sheets, towels, drying-up clothes, garden and swimming pool maintenance, if any, and V.A.T.

A - III 
The first payment of 40% is due after the reservation is confirmed and should be deposited by bank transfer to the account of:

The second payment of 40% is due thirty days prior to arrival and should be deposited by bank transfer to the account of

The following data will be specified:

·  full name of the reservation holder,
·  renting period
·  name of the rented house
·  reservation number.

The client will notify
Solymar-Holidays by fax of all payments made, to the following fax number: (44) 870-168-0529

The third payment of 20% is due in cash or by credit card
upon delivery of the keys.


B.  
CANCELLATION OF RESERVATIONS

B – I
Providing the client cancels a reservation more than 30 days before arrival,
10% of the advance will be forfeited.

·   50% will be forfeited, if the cancellation takes place more than 7 and less than thirty days before arrival.

·   If the reservation is cancelled less than seven days before arrival
100% will be forfeited.

B - II
Once the house has been rented and the company Alquileres Guzmán s.l. cannot deliver it, or is forced to cancel the reservation, the client will be offered the following alternatives: at the client’s discretion, the client may occupy another house whose characteristics are similar or superior to those of the house initially rented, or he may be refunded all the money paid for the reservation and an additional 25% compensation. Once the client has made his choice, he will forfeit his right to make a claim against Alquileres Guzmán.

B - III
If the client leaves the accommodation voluntarily, for any reason or under any circumstance, before termination of the contract, the company is not obliged to refund any fees paid.

C. DELIVERY AND RETURN OF THE HOUSE

C - I
Occupation of the accommodation will begin on the day of the arrival, from 17:00. During the first 48 hours following the occupation of the house, the client will notify Alquileres Guzmán s.l of any damage, breakdown or malfunction on the property so that the company can make the corresponding repairs as soon as possible. If no notice from the client has been received after the first 48 hours, Alquileres Guzmán will understand the house is in perfect condition. During the first two business days following the arrival of the client, notwithstanding the previous considerations, the staff of Alquileres Guzmán s.l will review, together with the client, the house’s inventory and ensure the working order of the electrical appliances. Departure (between 8:00am and 10:00am) will be arranged at least three days beforehand in order for the company’s staff to review, together with the client, the house’s condition, in order that the guarantee deposit can be refunded, and the keys returned to the caretaker.

C – II
The keys can be picked up at the offices of Alquileres Guzmán s.l., between 17:00 and 20:00 on the day of arrival. If the client is not able to arrive during working hours, he will contact Alquileres Guzmán to arrange the time when the keys can be picked up. If he fails to do so, the company will not be liable for any consequence arising from this fact. On receiving the keys, the client will leave a deposit of 150€, 300€ or 600€ (in cash or by credit card), depending on the category of the rented house. This deposit will be used as a guarantee that the client will take care of the furniture and fittings of the hired accommodation during the entire stay.

C - III
The client is responsible for leaving the house on the last day of his stay in the same condition as he found it, that is, clean and tidy. If he fails to do so, the company may add an additional charge to final cleaning costs.

C - IV
Clients must leave their rental accommodation as per the agreed date. In case of non-compliance, the company is entitled to receive compensation equivalent to twice the maximum daily price for each day past the contractual departure date.

C – V
Clients wishing to depart prior to the time or day stated in this agreement, must notify the company in advance. The guarantee will be refunded to them the following Monday after their departure providing that the house has been left in perfect condition.

 D. CONDITIONS OF USE, OCCUPATION OF THE HOUSE
 AND ITS SERVICES

D - I
The client will provide Alquileres Guzmán s.l. with the complete name and identity card or passport number of all people occupying the house during the entire stay. The number of people authorised in the reservation must be complied with. If the accommodation is occupied by a number of people exceeding the permitted capacity, the company reserves the right to cancel the rental contract immediately and take the relevant legal actions. Children more than two years old are regarded as adults in terms of occupation. Rollaway beds or similar furniture not included in the inventory are forbidden, unless the company gives its expressed consent.  

D - II
Domestic animals are not authorised unless with the company’s express consent. If this is not complied with, Alquileres Guzmán s.l. reserves the right to cancel the rental contract immediately, and to take the relevant legal actions. Apart from keeping the guarantee deposit, additional fees may be charged if the animal has caused any breakdown in the house, dirt or any other type of damage.

D - III
If any electrical appliance is out of order, or any breakdown is observed in the water, light, gas installations, or in other services, the client must inform Alquileres Guzmán s.l, so that the proper corresponding authorised technical service can be notified in order to repair the breakdown as soon as possible.

D - IV
When the client arrives, the house will be clean, with bath towels, kitchen towels, and beds made. Unless the client specifically requests anything different, the company will proceed, through its authorised staff, to change bed and bathroom linen once a week between Thursday and Monday, provided the client is staying for two weeks or more. Linen changing service will not be available during the last week. If the client expressly declines this home delivery service, he may can change linens and towels at the company’s facilities himself.

D - V
The client shall inform the company if he runs out of gas in order for the company to arrange replacement canisters as soon as possible.

D - VI
It is forbidden for the client to move furniture from their original location. If this rule is not complied with, the company reserves the right to keep the given deposit.

D - VII
The performance of any activity, that contradicts municipal regulations and the ordinary cohabitation, hygiene, and public order practices, or prevents the resting of other users of the building or housing development, is also forbidden. It is forbidden to make any noise, in the rented house or its surroundings after 24:00.

D - VIII
The client will not accumulate rubbish inside or outside the hired accommodation. All rubbish must be placed inside plastic bags and deposited it in the nearest container to the house. If this rule is not complied with, the company reserves the right to keep part of the guarantee.

E. EXCLUDED LIABILITIES

E – I
In case of power or water cuts, or noises arising from nearby works, disturbing the client during the client’s stay, Alquileres Guzmán s.l. undertakes no liability, as the situations are beyond its control, and are produced by third parties such as water and power supply companies, or even the Town Council.

E - II
The price of the stay does not include any of the following insurances: travel, theft, accident or civil liability arising from the client’s action to other people or property. Therefore, Alquileres Guzmán s.l. undertakes no liability for any eventuality occuring to the client in the situations described inside or outside the rented house. 

F. OTHER RECOMMENDATIONS

F - I
We recommend purchasing travel insurance.

F - II
Do not leave the house’s lights on unnecessarily.

F - III
Do not waste water.

F - IV
Do not leave valuable objects inside the house or cars if it is not occupied.  

After having examined the offer and pre-contractual information, and knowing all the characteristics, conditions and category of the accommodation, the client or agency accept this General Contracting Conditions on the following date and place:
